In accordance with Anti-dumping Regulations of the People’s Republic of China, Ministry of Commerce released announcement on July 1, 2003, deciding to carry out anti-dumping investigation on dispersion unshifted single-mode optical fiber (“investigated commodity” for short in the following) o riginated from the United States, Japan and the Republic of Korea. In line with investigation result as well as item No. 24 of the Anti-dumping Regulations of the People’s Republic of China, Ministry of Commerce released preliminary arbitration on June 16, 2004, confirming dumping of the investigated commodity as well as the causality between dumping of the invest igated commodity and the injury of domestic industries. After issuance of the preliminary arbitration, Ministry of Commerce continued to carry out investigation on dumping and dumping profit margin as well as injury and injury extent, and issued the final arbitration in light with investigation result and item No. 25 of the Anti-dumping Regulations of th e People’s Republic of China. Related matters are now announced as follows: I. Final Arbitration Through investigation, Ministry of Commerce finally rules the dumping of the investigated commodity, which injures the domestic industries. There is causality between dumping of the investigated commodity and the injury of domestic industries. II. Imposing Anti-dumping Duties In accordance with Anti-dumping Regulations of the People’s Republic of China, Tariff Committee of the State Council decides to impose anti-dumping duties on dispersion unshifted single-mode optical fiber originated from the United States, Japan and the Republic of Korea as from Jan 1, 2005. The tariff code of commodity with anti-dumping duties is 90011000, excluding other types of fiber, fiber optic bundle and optical fiber cable under the same tariff code. Rate of Anti-dumping Duties on Different Companies: Companies in the United States 1, OFS Fitel, LLC 46% 2, Other American companies 46% 3, Corning Incorporated The investigation result shows that the dumping profit margin of Corning Incorporated is 1.52%, which can be free of anti-dumping duties in light with item No. 27 of the Anti-dumping Regulations of the People’s Republic of China.
