2004-12-13 09:39 Ministry of Commerce issued announcement No. 41, 2003 on Aug 27, 2003, announcing the Ministry of Commerce Final Arbitration on Anti-dumping Investigation of imported catechol originated from EU. Since Aug 27, 2003, the People’s Republic of China began to impose anti-dumping duty on imported catech ol originated from EU.
San Jili Chemical Industry Co.. Ltd of Lian Yunguang put forward application of carrying out reexamination on dumping and dumping profit margin applied to anti-dumping of catechol originated from EU on Sep 27, 2004, claiming that the dumping profit margin from EU manufacturers and exporters grew inc reasingly during the year after the arbitration, which exceeded the tax rate of antidumping duty regulated by the arbitration. San Jili Chemical Industry Co.. Ltd of Lian Yunguang requested to calculate the dumping profit margin of the EU manufactures and exporters and amend accordingly tax rate of antidumping duty.
Ministry of Commerce received application on Sep 29 and delivered the open texts and non-classified summary of classified materials of the midterm reexamination application to the EU diplomatic mission in China. The French Rhodia Organique SAS submitted comment to Ministry of Commerce on Oct 19.
In accordance with the item 49 of Anti-dumping Regulations of the People’s Republic of China and the Temporary Regulations of Midterm Reexamination of Dumping and Dumping Profit Margin, Ministry of Commerce verified the corresponding evidences supplied by the interested parts in response to the the ir requirement during reasonable period after the anti-dumping duty took effect, and decided to carry out midterm reexamination on the dumping and dumping profit margin from the manufactures and exporters.
In accordance with the above regulations, Ministry of Commerce examined the qualifications of applicants, relevant conditions of the investigated products, export prices and the normal prices of in the relevant countries and regions. After verification, Ministry of Commerce considers that primary ev idence of San Jili Chemical Industry Co.. Ltd of Lian Yunguang coincides item 49 of Anti-dumping Regulations of the People’s Republic of China as well as the requirements of Temporary Regulations of Midterm Reexamination of Dumping and Dumping Profit Margin. Ministry of Commerce decides to carry ou t midterm reexamination on the dumping and dumping profit margin applied to the anti-dumping of catechol originated from EU as from the publication of this announcement.
The scope of the commodity is catechol with the PRC customs import tariff code of 29072910.
Inquiry period of the reexamination is from Sep 1, 2003 to Aug 31, 2004.The scope of reexamination is the tax rate of anti-dumping duty applied to catechol from EU manufactures and exporters.
