Qualification Standard of Coke Exporting Enterprises Coke exporting enterprises must meet the following requirements: (1) Production enterprises (a) Have registered through commercial and industrial administrations in accordance with related national rules, obtained qualifications of import and export business or registered for the record as foreign trade managers, and have the qualifications of independent legal person; (b) Meet the standard of coke trade access, the policies of related industries and the requirements in Emergency Circular of Distributing Some Ideas of Wind up and Regulate Coke Trade distributed jointly by nine ministries and commissions on May 27, 2004. Annual output is more than 0.6 million ton ( including 0.6 million ton). The annual output of foundry coke is more than 0.5 million ton (including 0.5 million ton.) (Taking the statistics of National Bureau of Statistics as the standard); (c) The coke export in last year is more than 0.2 million ton (including 0.2 million ton). The production enterprises that export by an agency of foreign trade company should provide export agency agreement signed with foreign trade company in the last year, show the certificate of duty drawback and declaration form drawn up by local administration of taxation. The enterprises that supply the commodities for foreign trade companies should provide the invoice of added value tax and as well as export certificate of the foreign trade company; (d) The quality of the commodities is up to present national standard and is authorized by ISO0900 quality system; (e) Up to Grade three of coking trade standard HT/T126-2003 of environmental protection of the People’s Republic of China. Have the control facilities of environmental protection that meets the needs of production scale. Discharge of main pollutants meets the related discharge standard of Comprehen sive Discharge Standard of Polluted Water and Comprehensive Discharge Standard of Air Pollution. Up to the standard with the evaluation of environmental departments above provincial level. And provide environmental supervision report of discharge that meets the standard in the present year; (f) Accord with related policies and rules of national management of land; (g) Abide by national laws and regulations. Pay social endowment insurance, employment insurance and medical insurance for workers and staff members in accordance with rules; (h) No activities of contrary to related national laws and regulations in recent three years. (2) Circulation Enterprises (a) Have registered through commercial and industrial administrations in accordance with related national rules, obtained qualifications of import and export business or registered for the record as foreign trade managers, and have the qualifications of independent legal person; (b) Registered capital is more than 30 million yuan (including 30 million yuan). The annual quantity of export is more than 0.1 million ton (including 0.1 million ton.) (Taking the statistics of National Bureau of Statistics as the standard); (d) As of it comes into effect, the exported products must be produced by the enterprises who meet the requirements of above standard (a), (b), (d), (e), (f), (g) and (h). And provide related materials of the enterprises who supply the commodities are up to the standard and invoice of added value ta x and the certificate of the supplier; (e) Abide by national laws and regulations. Pay social endowment insurance, employment insurance and medical insurance for workers and staff members in accordance with rules; (f) No activities of contrary to related national laws and regulations in recent three years. Foreign invested enterprises and coke exporting enterprises who are engaged in frontier trade should still act in accordance with present rules.] 2. Application Procedures All coke exporting enterprises should make an application to provincial competent commercial departments. Provincial competent commercial department should make preliminary qualification examination on the enterprises who apply for coke export quota in accordance with above qualification standard of coke exporting enterprises, and submit the name list of export enterprises who meet the requirements, written comment of preliminary examination to Ministry of Commerce (related materials of the enterprises should be enclosed) before November 20, 2004 and send a copy to China Chamber of Commerce of Metals Minerals & Chemicals Importers & Exporters (CCCMC) at the same time. Central-government managed enterprises should submit the application directly to the Ministry of Commerce, and at the same time send a copy to CCCMC & Chemicals Importers & Exporters (CCIA). Ministry of Commerce entrust CCCMC and CCIA to check the qualification of the enterprises that apply for coke export quota. CCCMC puts forward pooled suggestions to local coke exporting enterprises and Central-Government managed coke exporting enterprises that passed the check, and report them to the Ministry of Commerce before November 30,2004. Ministry of Commerce examines and approves the qualification of all coke exporting enterprises who make an application according to the review of CCCMC, and publish the result, and distribute coke export quota in accordance with it. 3. The materials that should be submitted All coke exporting enterprises and Central-Government managed enterprises should submit following materials when they make an application to provincial competent commercial department or the Ministry of Commerce: (1) Copy of Business license duplicate of legal person of the applicants and sealed registration form Sealed Registration Form of Record for Foreign Trade Manager or Qualification Certificate of Import and Export Enterprises of the People’s Republic of China; (2) Discharge Certificate of Attaining the Required Standard or Environmental Evaluation Report of Project Under an Authorized Plan issued by environmental department above provincial level and Evaluation Report of Environmental Supervision in the present year issued by provincial environmental depa rtment; (3) ISO900 Quality Certificate; (4) Production enterprises should provide agent export contact signed with foreign trade company last year and the certificate of tax drawback and declaration form drawn up by local department of taxation. As for the enterprises who supply commodities to foreign trade companies, related certificate should also be submitted by foreign trade companies while the invoice of added value tax is provided; Trade enterprises should provide related materials that the enterprises that supply them commodities that meet the requirements of the standard, related invoice of added value tax or certificate of no tax drawback and the certificate of suppliers; (5) The production enterprises should provide effective legal documents about occupying land issued by national land management department; (6) The certificate of having paid social endowment insurance, employment insurance and medical insurance for workers and staff members issued by labor and social security department. |
