Ministry of Commerce Announcement No.76, 2005 on Preliminary Arbitration on Ethylene-Propylene-non-conjugated Diene Rubber

In accordance with Anti-dumping Regulations of the People’s Republic of China, Ministry of Commerce released announcement on Aug 10, 2004, deciding to carry out anti-dumping investigation on ethylene-propylene-non-conjugated diene rubber (hereinafter referred to as “investigated commodities”) ori ginating from the U.S, the Republic of Korea and Netherlands.
Ministry of Commerce carried out investigation on dumping and dumping profit margin as well as injury and injury extent, according to the results of which as well as tem No. 24 of the Anti-dumping Regulations of the People’s Republic of China, Ministry of Commerce release preliminary attribution. R elevant matters are now announced as follows:
Preliminary Attribution: In accordance with investigation results, Ministry of Commerce confirms the dumping of the investigated commodities, ethylene-propylene-non-conjugated diene rubber industry injuries of mainland as well as the causality between dumping of the investigated commodities and the injury of mainland indust ries.
Deposit: In accordance with tem No. 28 and 29 of the Anti-dumping Regulations of the People’s Republic of China, Ministry of Commerce decides to carry out anti-dumping measures by means of deposit. As from Nov 16, 2005, importers should provide relevant deposits to customs of the People’s Republic of China for the importing of ethylene-propylene-non-conjugated diene rubber originating from the U.S, the Republic of Korea and Netherlands. The investigated commodities are under item 40027010 and 40027090 in Import and Export Tax Regulations of PRC.

All interested parties may submit comments in written form with relevant evidences to Ministry of Commerce in 20 days for consideration as from release of this announcement.
