Ministry of Commerce Announcement No.40, 2005 on Interim Review Decision on Imported Acrylic Ester

Ministry of Commerce issued Announcement No.3, 2003 on April 10, 2003 to start imposing anti-dumping duties on imported Acrylic Ester originating from ROK, Malaysia, Singapore and Indonesia. The anti-dumping duty rate on BASF PETRONAS Chemicals Sdn Bhd (Malaysia) was 4%, and that on PT. NIPPON SHOK UBAI INDONESIA was 11%.
Ministry of Commerce issued Announcement on July 5, 2004 to start a Dumping and Dumping Margin Interim Review on the anti-dumping duty rates applied to imported Acrylic Ester originating from BASF PETRONAS Chemicals Sdn Bhd (Malaysia) and PT. NIPPON SHOKUBAI INDONESIA.
The investigated product in the Interim Review, namely Acrylic Ester, is consistent with that in the anti-dumping investigation. The investigated product are listed under No. 29161200 in Import Tariffs of General Administration of Customs of PRC (2005).
In accordance with Article 50 of Anti-dumping Regulations of People’s Republic of China, Interim Review Temporary Regulations on Dumping and Dumping Margin issued by Ministry of Commerce, and decision made by Customs Tariffs Committee of the State Council, the arbitration of the Interim Review is a s follows:
1. The anti-dumping duty rate applied to imported Acrylic Ester originating from BASF PETRONAS Chemicals Sdn Bhd (Malaysia) shall be remained as 4%. Any tax rebate application raised by relevant Chinese importers of BASF PETRONAS Chemicals Sdn Bhd (Malaysia) between March 5, 2004 and June 1, 2004 sh all not be supported.
2. The anti-dumping duty rate applied to imported Acrylic Ester originating from PT. NIPPON SHOKUBAI INDONESIA shall be adjusted to 3%
Importers shall, while importing Acrylic Ester originating from BASF PETRONAS Chemicals Sdn Bhd (Malaysia) or PT. NIPPON SHOKUBAI INDONESIA as of July 5, 2005, pay relevant anti-dumping duties to General Administration of Customs of PRC. Anti-dumping Duty= Customs Tax Payment Price * Anti-dumping Du ty Rate.
The relevant interested parties, disagreed with the final arbitration or the imposition of the anti-dumping duties, could apply for an administrative reconsideration or lawsuit in accordance with Article 53 of Anti-dumping Regulations of People’s Republic of China.
