The Ministry of Foreign Trade and Economic Cooperation (MOFTEC) issued Announcement No.5 in 2001 to start imposing anti-dumping duties on imported Acrylic Ester originating in Japan and USA, the duration of which is 5 years as from November 23, 2000.
In accordance with Item 48 of Anti-dumping Regulations of People’s Republic of China, if the termination of anti-dumping through review leads to a continuous or recurrent dumping and injury, the imposition time limit of anti-dumping duties may be properly prolonged.
In March 2003, the first session of the Tenth National People's Congress approved that the anti-dumping investigation function would be handed to the reorganized Ministry of Commerce.
As of the date when the announcement is issued, domestic industry or relevant organizations may put forward written petition for review to the Ministry of Commerce 60 days before the termination of the anti-dumping measures. The petition shall include abundant evidence that the expiration of anti-du mping duties may again or continuously result in dumping or injury to the industry.
On condition that no domestic industry or relevant organizations put forward written petition for review, nor the Ministry of Commerce initiatively decides to start a review before the termination of the anti-dumping measures, the anti-dumping measures on imported Acrylic Ester originating in Japan and USA will be terminated as of November 23, 2005.
